By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. Scope of Services

Koja d’Or in Switzerland provides curated rental services for high-end chalets and villas in Europe. We act as an intermediary between property owners and guests and facilitate booking, payment, concierge, and post-arrival services. Koja d’Or in France provides a marketing platform representing the properties. All on-site services are provided independently by a third-party company.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use the Services. By accessing or using the Services, you represent and warrant that you meet these requirements.

3. Booking and Payment

3.1 All bookings made via Koja d’Or are subject to availability and written confirmation.

3.2 Prices are stated in Swiss francs or euros unless otherwise indicated. Taxes, cleaning fees, and security deposits may apply.

3.3 A deposit or full prepayment is required to secure your reservation. Payment terms and cancellation conditions are specified in each property’s individual booking contract.

3.4 Koja d’Or reserves the right to cancel bookings in cases of non-payment or suspected fraudulent activity.

4. Cancellations and Refunds

4.1 Cancellation policies vary per property and are clearly communicated prior to booking. You are responsible for reviewing the cancellation terms before confirming a reservation.

4.2 Refunds (if applicable) will be processed within 30 business days and may be subject to administrative fees.

5. Guest Responsibilities

5.1 Guests must treat the property, contents, and surroundings with care and respect. Damages, excessive cleaning, or violations of house rules may result in additional charges or forfeiture of the security deposit.

5.2 The number of guests must not exceed that specified in the booking.

5.3 Guests may not sublet the property or use it for commercial purposes without express written permission.

6. Owner Obligations

6.1 Property owners represent and warrant that they have the right to rent out their property and that it complies with applicable local regulations.

6.2 Koja d’Or is not liable for any failure by an owner to provide access to or maintain the property unless due to Koja d’Or’s own negligence.

7. Limitation of Liability

To the maximum extent permitted by law:

    •    Koja d’Or shall not be liable for any indirect, incidental, or consequential damages.

    •    Our liability for direct damages shall not exceed the total amount paid by you to us in connection with the relevant booking or service.

    •    We are not responsible for delays or failures caused by force majeure events or third-party service providers.

8. Insurance

Guests and property owners are responsible for obtaining adequate travel, liability, or property insurance. Koja d’Or may assist in recommending insurance providers, but is not liable for any loss not covered by insurance.

9. Data Protection and Privacy

We process personal data in accordance with our Privacy Policy. By using our Services, you consent to such processing and warrant that all data provided by you is accurate.

10. Intellectual Property

All content on our website, branding, trademarks, and digital systems are the exclusive property of Koja d’Or or its licensors. You may not copy, reproduce, or use our content for any commercial purpose without written consent.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Geneva, Switzerland.
